I.               CALL TO ORDER

 

The meeting was called to order at 7:00 p.m. by Chairman Zeiters.

 

II.             ROLL CALL - Noted by recording secretary.

 

III.           APPROVAL OF MINUTES

 

Mr. Bolt moved, seconded by Mr. Zeiters to approve the June 22, 2006 meeting minutes.  The motion passed with Mr. Wingeard and Mr. Ostermayer abstaining.

V.          SUBDIVISION/LAND DEVELOPMENT APPLICATIONS

B.             Preliminary and/or Final Subdivision/Land Development Plans

 

1.     #05.021 Millstone Phase III, S & A Homes Inc. – Mitch Kemp, J. Michael Brill & Associates, was in attendance to represent the plan.  Mr. Kemp explained lot configuration changes to some of the lots to accommodate the wetlands.

 

Mr. Brulo presented comments from his report dated 7/20/06 as follows:

#2  Revise plan sheets 8 & 9 with new lot lines and grading.

#3  Provide the executed easements for the structure encroaching on Lot 70.

#4B  Provide a water budget to the wetland area to insure adequate hydrology

 

Mr. Leonard presented comments from his report dated 7/13/06 as follows:

#1  There is a missing of preliminary and final plan sheets.  Please clarify.

#2  Sheets 4 and 6 don’t match the key map

#3  With slight modification to sheets 4 and 6, sheets 5 and 7 won’t be needed

#6  If something is complete and not applicable to this phase, remove from plan

#7 No need to duplicate general notes on multiple pages

 

Mr. Leonard present the following EAC comments dated 7/13/06:

#1  Was there a jurisdictional determination on this wetland?  Mr. Kemp stated “yes.”

#3  Modify the design of the swale to create a vegetated swale, improving water quality and providing infiltration.  This can be done by augmenting soil, adding facultative plants, and check dams.

 

MOTION #1

Mr. Ostermayer moved, seconded by Mr. Bolt to recommend approval of the following waivers:

1.              Section 173-15B(3) Driveway profiles

2.              Section 173-15B(20) Improvements on adjacent properties

The motion passed unanimously.

 

MOTION #2

Mr. Ostermayer moved, seconded by Mr. Bolt to recommend approval of final subdivision plan #05.021, Millstone Phase III of S & A Homes Inc., tax parcel #68-022-060 contingent upon:

·       Outstanding approvals from outside agencies

·       Paying the fee in lieu of parkland dedication

·       Posting of the proper improvement guarantee and execution of a development agreement

·       Approval of waivers by the BOS

·       Addressing outstanding review comments from the Township staff, Township Engineer, and other reviewing agencies, boards and committees

·       Other items determined necessary by Township Ordinances

The motion passed unanimously.

             

2.     #06.009 F/SB/LD Lexington Woods Revised – Dave Weibrecht, Alpha Consulting, was in attendance to represent the plan.

 

Mr. Brulo presented comments from his report dated 7/20/06 as follows:

#1  Waivers to Preliminary plan and Concrete Curbing are not needed.

#4  Provide an autoturn analysis adequate access for Township emergency services vehicles.

#11H  Clearly identify where porous pavement will be used in the development

#11I  Address drainage behind the proposed retaining wall

#12A  Revise the alternate pole height to be less then or equal to 10’

#12B  Clarify which luminaire details are correct

#13  Provide a fence wherever the height of the retaining wall is 4’ or greater.

 

Mr. Leonard presented comments from his report dated 7/13/06 as follows:

#2  Location of existing well for closure

#6  Provide school district review

#7  Submission of an appraisal of one buildable acre for FILO calculations

#8  Need a second street name for the new section of roadway

#10  Note on sheet 3 for street sign needs to be changed from Court to Drive

#11  Inlets in from on units 43, 41, 19 & 17 appear to be too close to driveways

Submit ownership & maintenance agreement for the open space

Submit a copy of the Condominium Owner’s Association agreement

 

Mr. Leonard present the following EAC comments dated 7/13/06:

#2  Existing tree and vegetation preservation – reference to this section should be shown on the plan.  Describe measures to preserve trees, such as “prevent root zone compaction.”

#4  Educate the individual unit owners on t he nature of the porous materials.  Provide a porous driveway maintenance plan to the Condo Association.

 

Bob Raffensperger, 223 Novak Road – Mr. Raffensperger expressed his concerns with the density of this development.  He also stated there are big problems with stormwater run off onto his property.  No one polices the site and the limit of disturbance lines.  There are construction vehicles all over the site.  The detention pond has at least 2 feet of water in it at all times and he has experienced substantial flooding of his property since construction began.  Mr. Raffensperger presented photos of the flooding to the Commission members.

(Considerable discussion took place at the Board table which is not reflected in these minutes).

 

Mr. Wingeard suggested the Township put pressure on the DCCD to obtain some relief for Mr. Raffensperger.  Mr. Wingeard stated he also had concerns about the pervious driveways and proper maintenance of them, along with traffic concerns.  Mr. Brulo will check on the infiltration volume.

 

Mr. Ostermayer commented on the mile a minute weed problem on site and asked to meet with the contractor/developer or engineer at the site to discuss ways to eradicate it.

 

Mr. Brulo presented comments from his TIS review:

#1  No existing traffic data was provided at intersections of Rt 22/Jonestown Road, Jonestown Road/Blue Ridge Avenue and Jonestown Road/Rt 39.

#2  New developments Mapleton Grove, Central Dauphin High School and Brookview should be considered in the report.

 

MOTION

Mr. Wingeard moved, seconded by Mr. Ostermayer to table plan #06.009 of Lexington Woods Revised due to outstanding staff and engineering comments.  The motion passed unanimously.

 

3.     #06.010 F/SB Steven & Susan Cover, 7122 Sleepy Hollow Road – Mr. Wakefield, Act One Consultants, was in attendance to represent the plan.  Mr. Wakefield explained this is a 2 lot subdivision from the previous 13 acre parcel of Pine Tree Estates.  It will create a new building lot for the Cover’s son.

 

Mr. Brulo presented comments from his report dated 7/20/06 as follows:

#1C  Wetlands certification note conflicts with note #5 on sheet 1 of 2

#1D  Stormwater management waiver is not needed.  This plan qualifies for an exemption.

#1E  Request exemption for land dedication, agree to pay FILO

#5  Can the existing driveway be relocated to obtain the required sight distance?  Mr. Wakefield indicated the sight distance is shown inaccurately on the plan, driveway functions well and meets ordinance requirements.

#9  Existing driveway either needs to be widened to 12’ or a waiver requested.

 

Mr. Leonard presented comments from his report dated 7/13/06 as follows:

#1  Provide an easement & maintenance agreement for share driveway

#2  Identify size of eastern drainage pipe under road

Open space ownership & maintenance agreements are needed

Provide a general characterization of existing trees and vegetation for lot 13B only.

 

Brian Dickson, DCPC presented the following comment:

#10  Show 50’ setback from floodplain district.

 

Mr. Leonard present the following EAC comments dated 7/13/06:

#1  Provide proper wetland note on the plan

Appears proposed house is within floodplain limit.  Discussion occurred on the floodplain issue.  Mr. Brulo requested the 100 year floodplain be shown on the plan defined from FEMA Mapping with panel reference number.  It was determined the house is not located in a floodplain.

 

MOTION #1

Mr. Bolt moved, seconded by Mr. Ostermayer, to recommend approval of waivers to:

1.              Section 173-11A Preliminary plan requirements

2.              Section 173-11B(2)(bb) Two foot contours

3.              Section 173-11B(3)(h) Wetlands modified

4.              Section 173-25J(2) & J(6) Driveway width

The motion passed unanimously.

 

MOTION #2

Mr. Bolt moved, seconded by Mr. Ostermayer to recommend approval of final subdivision plan #06.010 Steven & Susan Cover, tax parcel #68-006-015 contingent upon:

·       Approval of the sewage planning module by PADEP

·       Approval of waivers by the BOS

·       Addressing outstanding review comments from the Township Staff, Township engineer and other reviewing agencies, boards and committees

·       Other items determined necessary by Township Ordinances

The motion passed unanimously.
