The meeting was called to order at 7:00 p.m. by Chairman Zeiters.

III.           APPROVAL OF MINUTES

 

Ms. Buskirk, moved seconded by Mr. Ostermayer to approve the March 22, 2007 regular  meeting minutes.  The motion passed unanimously.

V.          SUBDIVISION/LAND DEVELOPMENT APPLICATIONS

 

A.             Conferral/Sketch Plan – Mark Johnson of RGS, presented a sketch plan for the Fowler property on Rt. 39.  The site consists of 57.3 acres and proposes a townhouse development.

 

B.             Preliminary and/or Final Subdivision/Land Development Plans

 

1.     #06.017 F/LD Summit Restaurant EAST – Mr. Hoover was in attendance to represent the plan. 

 

Engineering Comments: Mr. Brulo presented the comments from his report dated April 19, 2007.  Mr. Brulo noted he met with Mr. Hoover and many of the comments have been addressed.

#7  Planning Commission needs to review sidewalk location relative to Exit 77 project and potential for future development.

#8  Most of the Stormwater comments are address with the new stormwater plan.

#8F  The calculations for the runoff from the Bypass area show that 0.2733 acres are included in the drainage area.  The area shown on the Final Stormwater Management plan appears to include an area greater than 1.0 acres.  Confirm that all drainage areas used in the calculations match those surrounded by a drainage area boundary on the plans.

#13 We recommend the Township consider requesting the applicant to enter into an agreement to provide contribution to the future improvements associated with Rt.39.  Applicant was agreeable to the fair share.

 

Zoning Comments:  Mr. Leonard presented comments from his report dated April 20, 1997

#6 TIS mentions 1058 sq ft auto detailing business as part of the land development?

#9 Consider running Stormwater to corner of Jonestown and Harper Drive. Many need easement from Country Inn & Suites if water sent this way

Zoning:

#2  Sidewalk easement needed.

#3  What is the note on Sheet 3 of the plan indicating building heights may exceed the maximum with additional setbacks?

 

EAC Comments:  Ms. Buskirk present the EAC comments dated April 17, 2007

#1  EAC urges the use of water quality plantings with the drainage easement.  The PA BMP manual discourages use of turf grass in infiltration basins and trenches.  The maintenance notes on the plan should be edited to reflect these recommendations.  These areas should not be mowed.

Other #2  E & S plan still shows no LOD.  Mr. Hoover indicated the new submission does show the limits of disturbance.

 

Motion

Ms. Buskirk moved, seconded by Mr. Moyer, to table plan #06.017 F/SB/LD Summit Family Restaurant due to outstanding staff and engineering comments.  It was noted that if the plan is not complete for next submission an additional extension of time will be necessary.  The motion passed unanimously.

 

2.     #07.002 P/SB/LD Evergreen Ridge – Tabled.

 

3.     #07.005 P/SB/LD Oak Grove Manor – Mr. Wilson was in attendance to represent the plan.  This preliminary plan proposed 105 single family dwellings on 93.57 acres of the Resurrection Cemetery located on Oak Grove Road.  Mr. Wilson requested this plan be tabled until June.

 

Engineering Comments:  Mr. Brulo presented the comments from his report dated April 19, 2007

#7 Proposed lot C is shown without any proposed improvements.  Clarify the purpose of this lot.  Also, provide setback lines, improvements proposed, required and provide sight distance, etc. 

#19 Site plan note 1 states that building footprints are 35’ x 60’.  Is this intended to be a restriction to the plan?

#26 Provide autoturn analysis

#30 Provide wetland report

#31 Cover sheet indicated that land is required to be dedication for recreation.  Clarify where on the plan this area is located.  6.3 acres – looking to offer land to Township.

#33 Provide a TIS study

#34 Plans seem to show an emergency access easement between lots 33 & 34 and across the cemetery lot A.  Provide labels, a section detail and bearings and distances on the easement.  The deeds for lots 33 & 34 must reference the permanent easement.

#43  A pump station is proposed.  Clarify whether it is within an easement or on a lot of its own and provide the layout and details for it.

#46 Consider revising the rear lot lines of lots 50 – 53 where six lots meet at one property corner.

#49C  Provide facilities to meet the Water Quality requirements of the Ordinance including the Groundwater Recharge requirements, the Water Quality requirements and the Stream bank Protection requirements.

#50  Planning Commission needs to consider curbing and sidewalk locations along Oak Grove Road and Sterling Road.

#51 Township should consider requesting applicant to enter into an agreement for the proposed improvements in the area.

 

County Comments:  Mr. Dickson, DCPC, presented comments dated April 23, 2007

#17  County is concerned this development may create excessive marginal access on the major local and regional roadways in the area and advises the Township to look closely at this issue.

#22 Width at front building setback line: minimum 100 feet.  Several lots do not appear to meet this criteria.

 

Zoning Comments:  Mr. Leonard presented comments from his report dated April 13, 2007

#1  Will sidewalks on Oak Grove Road connect to Road C?

#4  Locate existing septic system for cemetery trailer

#6  Limits of Disturbance should be tighten up around building setbacks and SPODs.

#11  Any improvements planned for Oak Grove Road and Sterling Road East Intersection?

#12  On sheet 10, put lot numbers to match driveway site distances.

#14  Should emergency access from the cemetery be part of 2 private lots, or part of the common open space?

#15  Add FFEs to houses on grading plan.  Are yards shown as final grading?

Zoning:

#1  Remove building setback lines from SPOD.  Note in deeds not structures in rear yards in SPOD

#4  Show pedestrian access to open space around loop road.

#5  Landscaping Plan – Will any trees be protected between lots 45 & 59?  If so, characterize.

#6  Show sidewalk between Road A and northern property line.

 

EAC Comments:  Ms. Buskirk presented the EAS comments dated April 17, 2207

#7  Existing tree & vegetation preservation.  There should be a characterization of the trees in the forested areas shown on the plan.  Specimen trees should be identified and protected.

#8  LOD should be adjusted to encompass only areas that need to be disturbed.  The LOD should be shown to protect the wetland overlay district in conservation area A.  How will the LOD be marked on site?  Add this to the construction sequence.

 

PSAB plan review comments were faxed to Tom Wilson.  And it was noted that the plan was presented to the PSAB board a few months ago.

 

Motion

Mr. Ostermayer moved, seconded by Mr. Moyer to table plan #07.005 P/SB/LD, Oak Grove Manor, Roman Catholic Diocese of Harrisburg, due to outstanding staff and engineering review comments.

 

 

VIII.       NEW BUSINESS

 

A.          #2007-01 Conditional Use Request, Daniel Schiavoni, 1372 Northview Drive – Mr. Schiavoni explained that he wants to locate his personal residence on the property with a swimming pool in the rear.  The heliport would be located at the top of the hill in the approximate center of the 23 acres.  The area was somewhat cleared several years ago.  An application has been made to the FAA – the problem is they don’t come out to the site or grant approval until he knows he can proceed per Township Ordinances.

 

Mr. Leonard reviewed the ordinance requirements for the Conditional Uses for the house and heliport in the Conservation Zoning District.  A request for a waiver of the 48” fence was also considered. 

 

Motion #1

Ms. Buskirk moved, seconded by Mr. Ostermayer to recommend approval of Conditional Use Request #2007-01 of Daniel Schiavoni to erect a single family dwelling in the Conservation Zoning District.  Motion passed unanimously.

 

Motion #2

Ms. Buskirk moved, seconded by Mr. Ostermayer to recommend approval of Conditional Use Request #2007-01 of Daniel Schiavoni to construct a helipad in the Conservation Zoning District.  Motion passed unanimously.

 

Motion #3

Mr. Bolt moved, seconded by Mr. Ostermayer to recommend approval of a waiver to the 48’ fence requirement.  The motion passed unanimously.

 

A public hearing will be conducted on May 21, 2007 at 7:15 before the Board of Supervisors.

 

IX.           OLD BUSINESS

 

X.             OTHER BUSINESS THAT MAY COME BEFORE THE COMMISSION

 

A.          Mr. Leonard announced that the Planning Commission was asked to attend the May 14, 2007 Board of Supervisors workshop meeting.

 

B.          Ms. Buskirk reminded everyone about the Tire Recycling on April 26, 27 & 28 at the Compost Center.  HACC will also hold an electronics waste recycling on Saturday, May 19.
