I.               CALL TO ORDER

 

The meeting was called to order at 7:00 p.m. by Chairman Zeiters. 

 

II.             ROLL CALL

III.           APPROVAL OF MINUTES

 

Mr. Ostermayer, moved seconded by Ms. Buskirk to approve the January 25, 2007 regular meeting minutes.  The motion passed with Mr. Moyer abstaining.

V.          SUBDIVISION/LAND DEVELOPMENT APPLICATIONS

 

A.             Conferral/Sketch Plan

 

B.             Preliminary and/or Final Subdivision/Land Development Plans

 

1.    #06.017 F/LD Summit Restaurant EAST – Tabled, time extension until June, 30, 2007.

 

2.    #07.002 P/SB/LD Evergreen Ridge – Tabled.

 

3.     #07.001 F/SB Richard & Linda Dengler, 7460 Moyer Road – Mr. Cieri, Act One Consultants was in attendance to represent the plan.  Mr. Cieri reported that there is some information regarding the driveway that still needs to be provided.  Mr. Cieri also explained the re-charge to the wetlands.  Mr. Brulo believes there will be minimal impact to the hydrology of the wetland.

 

Mr. Brulo presented comments from his report dated February 14, 2007 as follows:

#2A  Provide a profile for the entire proposed driveway.  Add a note that it will not exceed 10% slope.

#2B  Provide a sight line profile to insure adequate sight distance.

#2C  Provide a construction detail.

#2D  Provide drainage computations.

#6  Provide a letter from the DCCD approving the E & S plan.  Mr. Cieri agreed to expand the limit of disturbance lines and flag them in the field.

#8  Clarify the buildable area, define on plan.

#10B  Explain why the drainage boundary is shown downstream of the high point and any culvert details if an existing cross culvert is the limit to the drainage area.

#10E3  Some infiltration trenches are on a 10% slope.  Mr. Cieri stated they will be flattened out to provide better drainge.

#10E6  Provide larger inlets to the trenches such as type M. 

Provide original lot areas on the plan and renumber new lots.

 

Mr. Dickson, DCPC, had no additional comments.

 

Mr. Leonard stated he has received the open space agreement and has no additional comments.

 

Ms. Buskirk asked if the open space conservation easement should have a separate document for maintenance.  Mr. Leonard stated that is usually the case for larger developments, for small subdivisions the one documents handle both.  Mr. Leonard read from the document he received which serves both purposes.

 

Ms. Buskirk also recommended a shared driveway.  This was not agreeable to the applicants.

 

MOTION #1

Mr. Ostermayer moved, seconded by Mr. Bolt to recommend approval of the following waivers:

1.     Section 173-11A Preliminary plan requirements

2.     Section 173-11B(2)(bb) Two foot contours

3.     Section 173-11B(3)(h) Wetlands Study

4.     Section 173-11B(2)(c) Driveway profiles

The motion passed unanimously.

 

MOTION #2

Mr. Ostermayer moved, seconded by Mr. Bolt to recommend approval of final subdivision plan #07.001, 7460 Moyer Road, Richard & Linda Dengler, applicants/owners, tax parcel #68-019-070 & 060 contingent upon:

·       Approval of waivers by the BOS

·       Approval of the E & S plan from DCCD

·       Providing open space ownership & maintenance documents

·       Paying the fee in lieu of land dedication

·       Addressing outstanding comments from  the Township Staff, Township Engineer, and other reviewing agencies, boards and commissions.

·       Other items determined necessary by Township Ordinances

The motion passed unimously.

 

              It was agreed that Mr. Cieri would submit the plan on Monday, February 26, 2007 for the March 5th BOS meeting or provide a time extension.

IX.           OLD BUSINESS

 

A.    Text Amendment – Kairos Design/Williams Holding GroupMr. Williams and Mr. Bachick were present to discuss the proposed text changes to the NC District.

 

By consensus the Planning Commission agreed to the following changes to Section 195-49 Development Requirements:

Add: B(1)(c) Minimum lot area for multi-family dwellings, townhouses 2,000 square feet.

 

Add: C(1)(c)  Development over 15 acres

Add [1]        Minimum twenty percent (20%) of usage to be non-residential (this was ok to a maximum of ???? to be determined)

 

Mr. Leonard commented that the Township needs to be careful not to create a commercial highway zone that allows residences.

 

There was considerable discussion on densities and scale of development versus property size.  Additional information is to be provided at the March 22, 2007 meeting.

 

 
X.             OTHER BUSINESS THAT MAY COME BEFORE THE COMMISSION

 

A.    JMT Report- Transportation – Mr. Leonard provided Planning Commission members with a handout titled Access Management for review before the March workshop meeting.  Data has been pulled together for JMT to process.  The workshop meeting will be Wednesday, March 14, 2007 at 7:00 p.m.

 

B.    Chairman’s Comments – Chairman Zeiters reported that the Pennsylvania Planning Association is talking about mandatory education for planning commission members.  Chairman Zeiters also informed the Planning Commission of three house bills:

#71              Would require the developer of a subdivision/land development to notify the school district of development and its impact.

#72              Allows school districts to put an educational value on the impact and levy a fee to the developer.  The plan would not be able to be recorded until the fees were paid.

#397  Townships to be allowed to collect impact fees for transportation, police, etc.
