WORKSHOP MEETING – ZONING ORDINANCE UPDATES

The workshop meeting came to order at 7:00 p.m.

 

ZONING ORDINANCE UPDATE #2

 

Mr. Leonard asked that the Commission consider a motion to forward the second set of Zoning Ordinance revisions to the Board of Supervisors.

 

Brief discussion occurred regarding the open space changes, with Mr. Moyer asking if he could work on some calculations on existing plans just to see how they would look with the new provisions. 

 

Motion

Ms. Buskirk moved, seconded by Mr. Bailey, to forward the second set of revisions to the Board of Supervisors for action.  The motion passed unanimously.

 

ZONING ORDINANCE UPDATE #3

 

Article XVIII General Regulations, Section 195-94, Accessory Apartments in FRA, RR and R-1 (delete R3) Districts

Amend to change:

Accessory apartments in the FRA, RR and R1 (delete R3) Districts shall meet the following standards.

 

Amend to add: 

G.         Two additional off street parking spaces shall be required for the accessory apartment.

 

Article XVIII General Regulations, Section 195-95.A., Accessory uses

Amend to change:

(7)        Accessory building or buildings shall not cover more than 10% of the net lot area in the R2, R3, HH or V or NC Districts.  An accessory building shall not be more than 35% of the gross floor area of the principal building.  (Net lot area shall mean, for the purposes of this section, the total lot area minus the floor area of the principal building).

 

Article XVIII General Regulations, Section 195-95D Fences or walls

Amend to add/change:

(1)                Any fence or wall in the front yard shall not exceed 3 ½ feet in height.

(2)                Any fence or wall in the side or rear yard may be six feet or more in height, provided that any fence or wall exceeding six feet in height shall contain openings therein equal to 50% of the area of that portion or the wall or fence exceeding six feet. Solid or opaque up to six feet in height, and may extend higher if at least 50% open in character to a maximum of 8 feet total.

(3)                Any fence in the front yard must be kept out of the road right-of-way.

(4)                Farm animal and livestock fences shall be exempt from (3).

 

Article XVIII General Regulations, Section 195-95F Swimming pools.

Amend to change:

(3)(a)    A swimming pool capable of containing water 18 inches or more in depth shall be completely surrounded by a fence or wall.  The owner responsible for operating or maintaining the swimming pool shall assure that all doors or gates in the enclosing fence or wall are closed or securely locked at all times when the pool is not in use by family members, guests or other persons authorized by the person responsible.  An enclosing fence or wall shall be not less than four (4’) feet in height, and shall be so constructed in order to prevent the passage of a sphere three four (4”) inches in diameter through any opening or under the fence.  A dwelling or accessory building may be used as part of such enclosure.

 

Article XVIII General Regulations, Section 195-96 Bulk area modifications and exceptions

Amend to change:

D.         Flag lots shall be prohibited except as provided in Section 195-88L.

 

E(2)      In addition to the requirements of Subsection D(1) 195-95D(1), on corner lots no wall, fence, sign or other structure in excess of 3 ½ feet in height shall be erected or altered and no hedge or other plant material in excess of 3 ½ feet in height shall be permitted within 25 feet in any direction of the intersection of the street right-of-way.

 

Section 195-97 Erosion and sedimentation control – to be revised with MS4 ordinance.

Section 195-98 Historic preservation – no changes

Section 195-99 Home Occupations – no changes

 

Delete entire Section 195-100 Operation & maintenance plans.

 

Section 195-101 Stormwater management and drainage – entire section to be repealed with MS4 Ordinance.

 

Delete entire Section 195-102 Waste and sewage disposal.

 

Article XVIII General Regulations, Section 195-103 100, (New 195-100A) Adult entertainment used in the IE I District.

Amend to correct:

Adult entertainment uses located in the IE I District shall meet the following requirements:

 

Article XVIII General Regulations, Section 195-111 (new 195-103I) Passive recreation areas in C district

Amend to delete/add:

Passive recreation areas, such as but not limited to day camps, picnic areas, archery ranges, paint ball ranges and gun clubs, located in the C District are regulated as follows:

 

(3)        At least one portable toilet shall be provided.

 

The next PC workshop meeting is scheduled for Wednesday, 9, 2005 at 7:00 p.m.
