CALL TO ORDER – 7:00 p.m.
Chairman Jones called the December 9, 2002, workshop meeting of the West Hanover Township Board of Supervisors to order at 7:00 PM followed by the Pledge of Allegiance.

PUBLIC COMMENT
Paul Hepler, Manager, Yingst Homes. Mr. Hepler
was representing Mr. Yingst regarding the status of the streets in the
Brynfield subdivisions being prepared for acceptance by the Township. Mr. Brulo, Township Engineer, had performed
his inspection and presented a list of deficiencies to Yingst Homes. These deficiencies included missing street
signs, missing street light, missing fire hydrant, the lack of curbing and
handicapped ramps in some areas, etc.
Work correcting these deficiencies is currently underway. Another inspection is scheduled for
Wednesday, Dec. 11. Some items cannot
be addressed at this time, therefore Mr. Hepler advised the Board that the
Improvement Guarantee Letter of Credit would remain in place in the current
amount; no reduction would be requested.
In addition the maintenance bond for each road would be issued. Mr. Hepler requested the Board accept the
dedication of these roads at its’ regular meeting on December 16, 2002. Mr. Yost stated that 2 issues were involved
in the Board’s prior action to table the acceptance of the roads: the legal
descriptions and the public improvements of each road. The legal descriptions have been
updated. He advised the Board that they
could accept the roads, from right-of-way to right-of-way, with the
contingencies for the remaining improvements.
PRESENTATIONS, STAFF/COMMITTE REPORTS
Bob Cristoff – Dauphin County
Conservation District – MS4 Permitting - Participation in the multi-municipal
MS4 Permit Efforts with DCCD. Mr.
Cristoff reviewed the background information regarding Act 167, Stormwater
Management Plans, and the history of the Act in West Hanover Township. West Hanover Township is included in the
existing Act 167 plan, completed in 1997, along with 4 other local
municipalities as part of 4 regional watersheds draining into the Swatara Creek
Watershed. We are required to update
the plan every 5 years and should incorporate the new standards for groundwater
recharge, water quality, and stream channel protection. Act 167 planning is being used to implement
these MS4 (Municipal Separate Storm Sewer Systems) regulations. The southern section of the Township, below
Route 22, is categorized as an MS4. We
will need to apply for a NPDES (National Pollutant Discharge Elimination System)
permit to discharge storm water from our MS4.
The application for the permit is due by March 10, 2003. The Dauphin County conservation District is
assisting municipalities with the permit process. Although Act 167 and MS4 are separate issues, there are
advantages to linking them together for the permit process. The DEP has developed a standard protocol or
“cook-book” approach for applying for the permit. This is not a required approach but has the advantage of no
review for permitting. The general consensus
of the Board was to work with the other municipalities in our Act 167 plan and
to use the Act 167 plan to meet the MS4 requirements. Mr. Rimer will complete the NPDES Phase II MS4 questionnaire
accordingly. The implementation of the
MS4 permit will be through existing or new ordinances and include: public
education, public involvement, construction site BMP’s, post-construction
BMP’s, illicit discharge detection and elimination, and good housekeeping
measures at municipal facilities. The
County pays for the cost of the plan with municipalities reimbursed 75% of the
cost of implementation by DEP.
